Subscription Terms and Conditions
Effective Date: May 2021
1. Definitions
“Effective Date” is the date you first register in Biorhythm Diagnosis Platform – Breast APP.
“Recommended Period” is
- Regular menstruation：7-10 days after the start of the menstrual period or 2-6 days after menstruation
- Irregular menstruation or over several months：2-8 days after menstruation or fixed period per month
- Menopause：Fixed period per month
“Professional Report” means the reports the system generated when the monitoring is over 6 hours and within the Recommended Period, and the products are in good contact with the breasts to avoid hypothermia.
“Care Reminder” means the risk reminder generated when the monitoring cannot meet the requirements.
“We”, “Us”, “Our” means HK Biorhythm R&D Company Limited. (“HK Biorhythm”)
“You” and “Yours” means the person who purchased this Subscription.
2. Subscription Benefits
Unless otherwise specified in the description of your Subscription plan during purchase, Your Subscription entitles you to these benefits:
2.1 Professional Report per month.
2.1.1 Every month, after you complete the monitoring process within the Recommended Period, one Professional Report will be sent through APP. additional monitoring suggested by all Professional Reports will be free.
2.1.2 If you monitor more than one time in the Recommended Period, you will only receive one Professional Report and afterwards, you will receive Care Reminder instead.
2.1.3 The number of Professional Reports is automatically deducted from “My Wallet” in the App each time the system issues a Professional Report. You can also check the remaining number of Professional Reports in “My Wallet - Professional Reports” in the App.
2.1.4 If you have irregular menstruation, please contact Customer Service for instruction.
2.1.4 When the subscription period expires, we have the right to terminate Professional Reports.
2.2 Care Reminder. The Reminder will be generated when the monitoring cannot meet the requirements.
2.3 Customer Service Support. Customer Service Support may include, but not limited to, handling of contacts.
2.4 Other benefits or promotions. In our sole and absolute discretion, we may include additional benefits, exclusive offer or promotions for our subscribers, subject to any additional terms and conditions described in such offer.
3. Changes to Subscription Benefits
We reserve the right to change these benefits or adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Except as otherwise expressly provided for in these Subscription Terms, any changes will take effect following notice to you.
4. Account Registration
In order to access or use certain features of the Subscription, You may be required to create an account in Biorhythm Diagnosis Platform – Breast APP (“Account”) and become a “Registered User” of the Subscription. During the registration process You will be required to provide certain information and establish a username and a password. You agree to provide accurate, current and complete information during the registration process and at other times when You use the Subscription and to update such information to keep it accurate, current and complete. HK Biorhythm reserves the right to refuse to keep Accounts for, or provide services to, any individual, if HK Biorhythm has a valid reason thereto. HK Biorhythm reserves the right to suspend or terminate Your Account, after sufficient notice, if any information provided during the registration process or at other times proves to be inaccurate, not current or incomplete. You are responsible for safeguarding Your password. You agree not to disclose Your password to any third party and to take sole responsibility for any activities or actions under Your Account, whether or not You have authorized such activities or actions. You will immediately notify HK Biorhythm of any unauthorized use of Your Account.
5. Termination
HK Biorhythm may, in its sole discretion, terminate or suspend your account for failure to timely pay any Fees (upon reasonable notice to you) or to provide accurate information, any breach of these Subscription Terms (or any other terms incorporated herein) or any abusive or fraudulent conduct towards any HK Biorhythm employees and we will not issue any refund, credit or other consideration.
6. Modification of Subscription and Terms
HK Biorhythm reserves the right to modify, terminate or impose additional terms and conditions to the Subscription and these Subscription Terms at any time by posting updated Subscription Terms. In addition, HK Biorhythm may modify the various Subscription Benefits available to subscribers from time to time by updating these Subscription Terms or subscription benefit descriptions on the website. HK Biorhythm will give you advance notice of any material changes to these Subscription Terms. Your continued use of the Subscription after we have posted the modification or, if applicable, receiving notice of the changes will constitute Your acceptance of the changes. We may also ask you to acknowledge your acceptance of the modified Subscription Terms. HK Biorhythm reserves the right to discontinue or terminate the Subscription in its entirety upon reasonable notice and we may, in our sole discretion, provide you with a refund, credit or other consideration.
7. Entire Agreement
The Subscription Terms constitutes the entire agreement between HK Biorhythm and You regarding the Subscription.
8. Assignment
You may not assign or transfer the Subscription Terms without HK Biorhythm’s prior written consent. We may assign this Subscription Terms, in our sole discretion, without restriction. Subject to the foregoing, the Subscription Terms will bind and inure to the benefit of the parties, their successors and assigns.
9. General
The failure of HK Biorhythm to enforce any right or provision herein will not constitute a waiver of future enforcement of that right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of HK Biorhythm. Except as expressly set forth in the Subscription Terms, the exercise by either party of any of its remedies under the Subscription Terms will be without prejudice to its other remedies hereunder or otherwise. If for any reason a court of competent jurisdiction finds any provision of the Subscription Terms invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of the Subscription Terms will remain in full force and effect.

11. Insurance
This is not a contract of insurance, an extended warranty or service contract.
12. Special Notes
